Sounds like you may need a rule evaluated in an after commit state.
I am a little confused though:
...after Refreshing the screen, exiting the BO and coming back.
So are you returning to the same new record? If so, surely this is working as intended since it would have had to be saved if you refreshed the page and/or exited the BO. Would you be able to clarify?
I'm with you it should be working, but it isn't.
After the save the field doesn't show back up although the LastModBy field shows as filled.
I know some things need a little extra push to update even after a save, so I have tried
- refreshing the screen
- exiting the business object and coming back
- changing user roles and then changing back
- Logging out and logging back in
None of these make the field appear
I think I'm doing all the right things, but not the resulted expected or needed

Maybe try this: $(if IsNull(LastModBy) then false else true). I used this to hide “Room” text box and after saving it became visible.
Assuming only OOTB rules, when you click “New Employee”, LastModBy should be null instead of empty.
